登録申込は「利用規約」に同意される方のみとさせていただいております。

第1条 趣旨
1.　大阪府立大学オンラインコミュニティ　OPU-Net 翔 利用規約（以下、「本規約」という）は、
　　大阪府立大学（以下、「大学」という）が管理する専用サイト「大阪府立大学オンライン
　　コミュニティ　OPU-Net 翔」（以下、「OPU-Net」という）の円滑な運営を図るために必要な
　　事項を定めるものです。
2.　OPU-Netは、大学や大阪府立大学校友会そして各同窓会と卒業生や在学生そして教職員等の広
　　範な連携とその活動の支援を目的としています。

第2条 利用資格
OPU-Netは、大学が許可した大学（全ての母体校を含む）の卒業生、在学生、教職員等（以下、「登録者」という）に限り、利用することができるものとします。

第3条 規約の同意
1.　OPU-Netの登録者は、OPU-Netのサービスを利用することにより、本規約すべての記載内容に同
　　意したものとみなされます。
2.　大学が、登録者に対して発する所定の通知は本規約の一部を構成するものとします。

第4条 規約の変更
1.　本規約は大学の判断で事前に通知することなく任意に変更されることがあります。将来引き続き
　　ご利用になる場合は、変更後の内容に同意しているものとみなされます。
2.　本規約の変更は、大学が変更後の規約をOPU-Netのウェブサイト上に表示した時点より効力を生
　　じるものとします。

第5条 利用の際の注意
1.　大学は、原則として登録者間の通信や活動に関与いたしません。万一登録者間の衝突があった場
　　合も、極めて悪質な行為と判断される場合を除き、それは当事者間で解決するものとし、大学で
　　は一切の責任を負わないものとします。
2.　大学は、登録者が自ら登録する情報の内容について、その信頼性を保証するものではありませ
　　ん。登録者は自ら正確な情報を登録、更新することに努め、また、情報を閲覧するときはその情
　　報を閲覧する登録者の責任において信頼性を判断し、利用します。
3.　登録者は、OPU-Netでの自らの行為において責任を負います。不正確な情報の登録や、悪質な情
　　報の発信等が法令違反や権利侵害にあたる場合には、損害賠償などの民事責任の他、刑事責任
　　を問われる可能性があります。また、登録者がOPU-Netに登録またはOPU-Netを通じて発信する内
　　容について、著作権・肖像権等の法令を遵守するとともに、またデータの保存、複製利用等につ
　　いても自らの責任でおこなってください。

第6条 禁止行為
1.　登録者にOPU-Netを有益に利用いただくため、OPU-Netでは以下の行為が禁止されています。
　　・法令に違反する行為、および違法な行為を勧誘または助長する行為
　　・公序良俗、一般常識に反する行為
　　・他の登録者または第三者、もしくは大学に不利益を与える行為
　　・サーバーに負担をかける行為、および他の登録者のアクセスまたは操作を妨害する行為
　　・OPU-Netの運営またはネットワーク・システムを妨害する行為
　　・他人の名誉、信用、プライバシー権、パブリシティ権、著作権、その他の権利を侵害する行
　　　為
　　・民族・人種・性別・年齢等による差別につながる表現の掲載
　　・選挙の事前運動、選挙運動またはこれらに類似する行為、および公職選挙法に抵触する行為
　　・商業用の広告、宣伝を目的とした登録内容その他コンテンツ、スパムメール、チェーンメー
　　　ル、MLM、その他勧誘を目的とする情報を登録したり、私書箱機能などの方法で送信（発信）
　　　する行為
　　・自分以外の人物を名乗ったり、代表権や代理権がないにもかかわらず会社などの組織を名乗っ
　　　たり、または他の人物や組織と提携、協力関係にあると偽ったりする行為。故意過失に基づき
　　　誤認した場合も含みます。
　　・他の登録者の個人情報を収集・蓄積する行為
　　・OPU-Net内のサービスに関わる記載について、無断でそのコピー、複製、アップロード、掲
　　　示、伝送、配布等をする行為
　　・同じアカウントを複数人で利用、または一時的に登録者以外の個人に利用を許可する行為
　　・その他大学が不適切と判断した行為
2.　前項に定める行為が確認された場合、大学は、登録者に事前に通知することなく、登録情報の変
　　更、削除、または登録の取り消しを含めた然るべき処置をとることができます。
3.　規約違反への処置に関する質問・苦情は一切受け付けることはできません。

第7条 サービスの中断及び終了
1.　大学は、OPU-Netの一部またはすべてのサービスをいつでも任意の理由で一時的に中断または終
　　了することができます。
2.　大学がOPU-Netのすべてのサービスを終了する場合、大学は相当の周知期間をもって登録者に通
　　知する。通知の方法はOPU-Netのウェブサイト上の掲載及び、OPU-Netに登録のあるメールアドレ
　　スに通知内容を記したメールを送信します。
3.　大学は、登録者に対してOPU-Netのサービスの中断または終了に伴い生じる損害、損失、その他
　　の費用の賠償又は補償を免れるものとします

第8条 登録者の登録情報について
1.　以下のいずれかにあてはまる場合には、大学は登録者が登録した情報、利用履歴、メールの内容
　　などの確認を行い、場合によってはこれらの情報を第三者に開示することがあります。
　　・裁判所、警察、その他の司法もしくは行政機関、またはこれらに準ずる者から適法に照会があ
　　　った場合
　　・OPU-Net またはそのシステムの維持に問題が生じる場合
　　・法令または大学が定める規約に違反し、その他社会通念上問題があると判断された場合
　　・大学、他の登録者、またはその他の第三者の権利、または利益を保護するため必要な場合
2.　大学は、大学の個人情報保護基本方針に則り登録者がOPU-Netで登録する個人情報を保護し、別
　　途定めるプライバシーポリシーを遵守します。

第9条 免責事項
1.　登録者が法令または本規約に違反した場合には、大学に対して有する権利、主張、法的措置、訴
　　訟、訴訟手続きの全てから大学を免除し、放免するものとします。
2.　大学は、登録者がOPU-Netの利用によって、他の登録者又は第三者に対して損害を与えた場合、
　　その一切の責任を負わないものとします。
3.　大学は、登録者がOPU-Netを通じて得る情報などについて、その完全性、正確性、確実性、有用
　　性など、いかなる保証も行わないものとします。
4.　大学は、登録者が使用するいかなる機器、ソフトウェアについても、その動作保証を一切行わな
　　いものとします。
5.　OPU-Netの利用の際に発生した、電話会社又は各種通信業者より請求される接続に関する費用
　　は、登録者が自己の責任において管理するものとし、大学は、いかなる保証も行わないものとし
　　ます。

第10条　法的手続き
この利用規約の準拠法は日本法とします。また、OPU-Net またはこの規約に関連して大学と登録者の間で生じた紛争については大阪地方裁判所を第一審専属管轄裁判所とします。

附則
この規約は、平成２１年４月１日から施行します。


Terms of Use for Osaka Prefecture University Online Community “OPU-Net Sho”
Only those who agree to the Terms of Use may make an application for registration.

Article 1 (Purpose)
1.　The Terms of Use for Osaka Prefecture University Online Community “OPU-Net Sho” 
　　(hereinafter, “Terms of Use”) set forth matters required for smooth operation 
　　of a dedicated website, “Osaka Prefecture University Online Community OPU-Net Sho”
　　(hereinafter, “OPU-Net”), managed by Osaka Prefecture University(hereinafter, 
　　“University”).
2.　OPU-Net aims to support the wide-ranging cooperation and activities of the University,
　　the Osaka Prefecture University Alumni Association, alumni associations, graduates,
　　current students, faculty members, etc.

Article 2 (Qualification for Use)
　Only the University’s (including all of its parent schools’) graduates, current
　students, faculty members, etc. authorized by the University (hereinafter,
　“Registered User”) may use OPU-Net.

Article 3 (Agreement to Terms of Use)
1.　Registered Users of OPU-Net will be deemed to agree to all the details of these Terms
　　of Use when they use any of the services offered by OPU-Net.
2.　The prescribed notice that the University issues to Registered Users shall constitute
　　a part of these Terms of Use.

Article 4 (Amendment to Terms of Use)
1.　These Terms of Use may be amended at the discretion of the University and without
　　prior notice. Your subsequent use of OPU-Net will be deemed to be your agreement to
　　the amended Terms of Use.
2.　Any amendment to these Terms of Use shall take effect from the time when the
　　University makes the amended Terms of Use available on the OPU-Net website.

Article 5 (Precautions for Use)
1.　In principle, the University will not be involved in any communication or activity
　　between Registered Users. Even in the event of a dispute between Registered Users,
　　the parties to such dispute shall resolve it themselves, unless such dispute is
　　considered to be an extremely malicious act. The University will not assume any
　　responsibility in this regard.
2.　The University will not guarantee the reliability of information registered by 
　　Registered Users themselves. Registered Users shall strive to register and update
　　accurate information themselves. When browsing for information, the Registered User
　　concerned shall judge the reliability of the information on his/her own responsibility
　　before using such information.
3.　Registered Users will be held responsible for their own conduct on OPU-Net.
    Where registration of inaccurate information, transmission of malicious information,
    etc. amounts to a violation of laws or regulations or an infringement of any right,
    the Registered User concerned may be subject to civil liability for damages and/or
    criminal liability. Furthermore, in relation to content that Registered Users register
    with, or transmit through, OPU-Net, such Registered Users shall abide by laws and
    regulations pertaining to copyright, portrait right, etc., and shall store, reproduce,
    use, etc. data on their own responsibility.

Article 6 (Prohibitions)
1.　In order to facilitate Registered Users’ beneficial use of OPU-Net, the following
　　acts are prohibited on OPU-Net:
　　・any act in violation of laws or regulations, or any act inducing or assisting 
　　　illegal conduct;
　　・any act contrary to public order, morality or common sense;
　　・any act detrimental to other Registered Users, third parties or the University;
　　・any act placing a burden on the server or interfering with other Registered Users’ 
　　　access or operation;
　　・any act interfering with the operation of OPU-Net or any network system;
　　・any act infringing others’ reputation, credibility, privacy rights, publicity
　　　rights, copyrights, or other rights;
　　・the publication of any expression leading to discrimination against ethnicity, race,
　　　gender, age, etc.;
　　・any pre-election campaign, election campaign, act similar to such campaign, or act
　　　in violation of the Public Offices Election Act;
　　・the registration or transmission (sending out), by using such means as the private
　　　mailbox function, of any data or content for commercial advertisement, spam mails,
　　　chain mails, MLM content or information aiming for solicitation;
　　・the misrepresentation of oneself as another person, the representation of oneself
　　　as an organization such as a company without the right to represent it or to act
　　　as an agent, or any deception that one is affiliated or has a cooperative
　　　relationship with another person or an organization, which includes cases of
　　　intentional or negligent false recognition;
　　・any act of collecting and/or accumulating the personal information of other
　　　Registered Users;
　　・any act of copying, reproducing, uploading, displaying, transmitting, distributing,
　　　etc. any description relating to the services available on OPU-Net,
　　　without authorization;
　　・any act of using a single account by multiple persons, or temporarily allowing an 
　　　individual other than Registered Users to use OPU-Net; and
　　・any other act that the University finds inappropriate.
2.　Upon becoming aware of the performance of any of the acts listed in the preceding
　　paragraph, the University may, without prior notice to Registered Users,
　　take due action
　　including change or deletion of registered information and revocation of registration.
3.　No question or complaint as to any breach of the Terms of Use shall be accepted.

Article 7 (Suspension or Termination of Service)
1.　The University may temporarily suspend or terminate the services of OPU-Net in part
　　or whole at any time and for any reason.
2.　In the case where the University is to terminate all the services of OPU-Net,
　　the University will notify Registered Users to that effect over a reasonable period
　　of time for familiarization purposes. As to the notification method, the University
　　will publish such notice on the website of OPU-Net, and send out an email containing
　　the details of such notice to each email address registered with OPU-Net.
3.　The University will be exempted from any liability for damages or compensation to
　　Registered Users for any damage, loss or cost arising in relation to suspension or
　　termination of the services of OPU-Net.

Article 8 (Registered Information of Registered Users)
1.　In any of the following situations, the University may check information registered
　　by Registered Users and/or their use history, email contents, etc., and disclose such
　　information, etc. to a third party depending on the circumstances:
　　・where a lawful inquiry is made by a court of law, the police authority, other
　　　judicial or administrative authorities, or a party equivalent to those
　　　organizations;
　　・where otherwise a problem arises in the maintenance of OPU-Net or its system;
　　・where there is a violation of any laws, regulations or the University’s rules,
　　　or where there is found to be any other problem in light of commonly accepted
　　　norms; or
　　・where it is necessary for the protection of the rights and/or interests of the
　　　University, other Registered Users or other third parties.
2.　The University shall protect the personal information registered with OPU-Net by
　　Registered Users in accordance with the University’s fundamental policy for the
　　protection of personal information, and shall comply with its separately prescribed
　　privacy policy.

Article 9 (Exemptions)
1.　In the case where a Registered User is in breach of any laws, regulations or these
　　Terms of Use, the University will be exempted and discharged from all rights, claims,
　　legal measures, legal action or legal proceedings that the Registered User has
　　against the University.
2.　The University will not assume any responsibility for damage caused by the use of
　　OPU-Net by a Registered User to another Registered User or a third party.
3.　The University will not guarantee, in any form, the integrity, accuracy, certainty,
　　utility, etc. of information that Registered Users obtain through OPU-Net.
4.　The University will not guarantee, in any form, the operation of any device or
　　software that Registered Users use.
5.　Registered Users shall, on their own responsibility, manage their own access-related
　　costs incurred for their use of OPU-Net and charged by a telephone company
　　or a telecommunications carrier of some type, and the University will not give
　　any kind of endorsement.

Article 10 (Legal Procedures)
　The governing law of these Terms and Use shall be the laws of Japan. Further,
　for any dispute arising between the University and a Registered User in relation to
　OPU-Net or these Terms of Use, the Osaka District Court shall be the court of first
　instance with exclusive jurisdiction.

　Supplementary Provision
　　These Terms of Use shall come into force on April 1, 2009.
